European Commission addresses dispute over Poland’s Constitutional Tribunal - EXCLUSIVE
The European Commission is closely monitoring the latest developments concerning Poland’s Constitutional Tribunal.
This was said by the source in the European Commission in an exclusive interview with CE Report.
The Commission said Polish authorities are responsible for ensuring that the Tribunal operates in accordance with the Polish Constitution and the relevant case law of the Court of Justice of the European Union (CJEU).
It also stated that the appointment of eight new members of the Constitutional Tribunal falls within the constitutional powers of Poland’s parliament, the Sejm. The Commission noted that this was confirmed by the Venice Commission in its opinion of October 13, 2026.
The Commission further referred to interim measures issued by the European Court of Human Rights (ECHR) on May 5, 2026. The measures oblige the competent Polish authorities not to hinder judges appointed by the Sejm in March 2026 from taking up their positions and performing their judicial duties.
