Poland plans nationwide register for property managers

Amendments to the Real Estate Management Act have been added to the Polish government's legislative agenda. The proposed changes aim to improve the quality of services provided by property managers, enhance the protection of property owners and homeowners' associations, and establish clearer rules governing the profession.

The draft legislation responds to shortcomings identified in the current legal framework regulating property management activities, CE Report informs via the Ministry of Economic Development and Tecnology of the Republic of Poland's official website.

"The current model does not provide adequate oversight of individuals working as property managers. The proposed changes will better protect the interests of property owners, homeowners' associations, and building users. They will also increase transparency in the property management market and ensure appropriate service standards," said Deputy Minister Tomasz Lewandowski.

The most significant change is the creation of a nationwide register of property managers. Registration will become mandatory in order to practice the profession. Property managers will be required to provide information in the register, including details of their professional liability insurance and the entities they manage. They will also be subject to an obligation to continuously improve their professional qualifications.

The draft law also provides for the reintroduction of a professional disciplinary system. Complaints may be submitted to a Professional Responsibility Commission, which will operate under the minister responsible for construction.

In addition to professional disciplinary measures, the legislation introduces administrative financial penalties. The minister will be empowered to impose fines on property managers who provide false information or fail to update the mandatory register.

The amendments will also clarify the legal definition of property management and specify the duties for which a property manager will be mandatorily responsible, regardless of the scope of responsibilities set out in the property management agreement.
